These terms and conditions of use are valid between Gojol, Teylestr.16, 44791 Bochum, Germany (hereinafter called gojol) and the member, a registered user who make use of gojol's offer. Gojol has everytime the right to modify or change the terms and conditions without notification of the members. It is the task of the member to inform about changed terms. Modified terms are valid immediately.

gojol's offer

Gojol offers its members a platform where they can portray themselves on a site or get in touch with other users by sending messages, upload pictures and videos or create blogs or groups. The trouble-free operation of the platform can not guaranteed as the accessibility of gojol may be compromised due to several influences. Gojol is for private use only. Commercial use without notification to gojol is strictly prohibited.

Membership fees

Subscription and use of gojol service is free for users. The user only has to pay for his own internet access.

Membership

To use the service of gojol the user has to register to create a member account. The membership requires the prior acceptance of these terms and conditions of use and have to be at least 18 years of age or the permission of their parents to use gojol. Every member have to register only once and assures with his registration not to be a member of gojol yet. The data requested upon registration have to be stated correctly and completely. Gojol can check these data with regard to completeness and accuracy. Where data change over the course of the membership the member has to adjust the data in his or her profile without delay. There is no claim to become a member of gojol and the membership can be cancelled by both parties without giving reasons or notice. Reasons for cancellation are for example when a member breach these terms and conditions, enter wrong statements or data, publishes unlawful contents or other reasons.

Data Protection and Privacy

Gojol as a platform saves your personal information like Name, Email-address and other informations you enter. Gojol will never transfer your data to third parties, but it is possible that we will refer your data to other service providers to optimize our service for you. This is for example when we use third parties to manage our business like host or server. When a member violates applicable law, the data can be transfered to responsible institutions . As a social network gojol can only work correct when the users specify a minimum of personal data. The data entered during registration process or later in your profile will be directly displayed at your profile page and is visible for other users. But you have the ability to hide your data from the public by using privacy settings in your membership options. You have also the ability to upload photos or videos or write some text. By default all the data is visible to other users. Be sure to hold the copyright of your uploaded content. Gojol may analyze users’ behaviour and profile in order to synchronize the offered content with the users’ needs. However, data are not processed with respect to the person but anonymously. We do the best to protect your data from third party access. But new viruses sometimes have the ability to break security barriers and therefor a totally protection of your data can never be granted. Gojol can save the user's IP-Address, the respective time, the respective name of the visited site or other information like the browsers name to identify a perpetrator where it is necessary. It's a benefit for all users to do so. After cancellation of membership the data can not be accessed or query any more. In case of sale of this service the data can be transferred to the new owner. Be sure that the actual Policy will stay in tact in this case.

Prohibited content or activities

Every member is responsible for the contents and links he uploads to gojol. He also is responsible for contents that other users leave at his profile, blog or groups. The content do not have to breach applicable law, affect public morality or infringe the rights of third parties like copyright. The member have to delete such contents without delay. Examples for activities or contents that are not allowed:

• Contents that hurts the right of other persons particularly the copyright
• Upload of pictures or videos without the permission of the photograph or the right owners
• Contents which are morally harmful to youth
• Contents which display pornography like naked persons not even as virtual pictures
• Contents that violate human dignity
• Obscene content
• Racist content or contents that inciting violence or hatred against other people or segments of the population
• Extreme politically or religious content
• Advertising products or services
• Requesting personal data of gojol's users

Gojol has the right to delete or modify unlawful contents or links without any notice

Password

The members password has to be kept secret from third parties like other persons. When the member believes that the password has become known by another person, he have to change it without delay.

Limitation on liability

Gojol does not take on responsibility for contents uploaded by members. The using of gojol is on the users own risk. Gojol does not take responsibility for damage of the users computer or the health of the user. There is no right to free support.

Release by registered user

Where gojol is subject to claims due to contents uploaded by a member, the member will release gojol from these claims upon the first request without delay. This claim of release includes all costs of necessary legal defence arising for gojol.

Severability clause

Where individual or several provisions of these terms and conditions of use are or become invalid or not feasible partly or completely or where these terms and conditions prove to be incomplete, the validity of the other provisions of these terms and conditions of use is not affected hereby. Instead of the invalid or not feasible provision, the valid and feasible provision that comes closest to the purpose of the invalid provision shall apply. In the case of incompleteness, the provision that would have been agreed upon for the purpose of these terms and conditions of use, had the parties of the contract thought of the problem beforehand shall be deemed as agreed upon.

Place of jurisdiction and applicable law

Place of jurisdiction for all legal disputes in connection with these terms and conditions of use is Bochum, Germany. The terms and conditions of use are subject to the law of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods.
